To this end the following items are included in this Stud Contract: Bitch Qualifications ~ The owner/leasee of the bitch agrees: 1. Bitch must be registered with AKC and/or USRC and must be over 24 months. 2. Bitch may have no disqualifying faults per the AKC/USRC Breed Standard for the Rottweiler and all genetic and/or health problems which exist or have existed in the bitch must be disclosed to Stud Dog owner. 3. Bitch must have good temperament. If the bitch is not titled in a way to make good temperament probable, bitch owner agrees to make bitch available for examination by Stud Dog owner. 4. To provide a copy of the bitch's pedigree, registration papers, CERF dated within a year, OFA clearances, recent photos and a current brucellosis test (within two weeks) & proof of all recent immunizations. 5. To keep the bitch confined and guarantees that the bitch has not been exposed to any other males from the start of her heat cycle until the time of delivery to the stud dog location. 6. To notify the Stud Dog owner within 48 hours after whelping or within 1 week of the due date if no litter is whelped. 7. To cull puppies in accordance with the Breed Standard with regards to white or non regular colors. 8. To have all tails docked and at least the rear dew claws removed before the age of 5 days. 9. Bitch Owner is responsible for any and all fees associated with breeding, including but not limited to veterinary services, shipping fees, ovulation timing or artificial insemination fees. The Stud Dog owner guarantees to make every attempt to contact the bitch owner before ANY veterinary care is rendered but in case of an emergency, the bitch owner agrees that veterinary care and any emergency decisions can be made by the stud dog owner. 10. To provide a copy of the litter record sheet to stud dog owner, which is to include puppies sex, color, tail length, etc as well as the names and address of puppy buyers. 11. To sell pet quality puppies as Non-Breeding, Limited Registration with the relevant box checked on the registration papers. 12. Not to sell any puppies from this breeding through a commercial dog center, nor to anyone intending to breed for commercial resale. 13. To rescue or take back (should the need arise) any puppies from this breeding. 14. To notify stud dog owner of any puppies from this breeding that complete Championship, Obedience, Working or other titles. Stud Fees/Expenses ~ The owner of the stud dog agrees: 1. Stud Dog is registered with AKC & USRC, he doesn't have any disqualifying faults per the AKC/USRC Breed Standard and is at least 2 years old 2. To provide a copy of stud dog's pedigree, registration papers, CERF dated within a year, current brucellosis test, recent photos and proof of all recent immunizations. 3. To keep the bitch confined and assures she is not mated with any other dog. 4. A Stud Fee of: A. Total stud fee $____________ to be paid in full before mating. 1. The stud dog owner guarantees that the bitch whelp two live puppies. If the bitch fails to whelp or whelps less than two live puppies, the stud dog owner will provide a repeat stud service to this bitch or a substitute bitch owned or co-owned by the same owner. In the case of a substitute bitch, all requirements of the original contract must be met. In the case that the bitch changes ownership, there is no obligation on the part of the stud dog owner too provide a repeat service. 2. If, after the second mating/insemination, the original bitch again fails to whelp, the stud dog owner will offer services of stud dog once more only after the bitch has undergone examination by a reproductive veterinarian and has had ovulation timing. 3. If the stud is no longer available for whatever reason, for the return service, the stud dog owner or agent reserves the right to offer a different stud to the bitch owner. 4. The stud fee will not be refunded in part or full, for any reason. 5. If a puppy is received back by the stud dog owner in lieu of stud fee, stud dog owner will be added as litter co-owner and "Von Schaefer's" will be included as part of each puppies name. Stud dog owner will choose pick puppy by the 7th weeks and has the right to choose any puppy from the entire litter. 6. To sign registration papers after stud fees are paid in full, upon fulfillment of the above agreement. ~Stud Dog Owner or Agent will not be held responsible for disease, accident, loss, injury or death to the bitch or any other person or animal while on the premises or in transit. By signing this contract both parties agree to the conditions set forth in this contract. Bitch Owner & Stud Dog Owner agrees that Maine State Laws apply to this contract and further agree that the place of venue, if needed, shall be Okaloosa County.
